Can adopt children aged 18 and over

If you want to adopt a child in Germany, you must have unlimited legal capacity under German law and be at least 25 years old. If you are married, at least one of both spouses must be that old and the younger spouse must be at least 21 years old. There is no maximum age for adoptive parents. According to the Federal Association of State Youth Welfare Services, however, the age difference to the adopted child should correspond to a natural difference.

Normally, a married couple - regardless of gender - can only adopt a child together. But single people can also adopt a child.

The adoption agency checks your suitability as an applicant. The following criteria, among others, are essential:

  • Personality - These include, for example, your motivation for adoption, the ability to get involved with the child, tolerance, willingness to inform the child about his or her ancestry and to continuously deal openly with the child's history.
  • Partnership stability - It is important for a child to grow up in a stable partnership. It is important that you have a good common foundation in your partnership and know how to deal constructively with conflicts.
  • Your willingness to deal openly with adoption: You should be willing to inform the child about his or her origin and to deal with this issue openly.
  • Health - You should be healthy physically and mentally to ensure that you can care for the child for a long time.
  • Parenting Ideas - You should study your ideas about parenting. It is important not to transfer the upbringing you have experienced yourself to the child without reflection.
  • Living conditions - The living space should be sufficiently large so that the child has the opportunity to develop in their own play and living area. Contact with other children should be possible in the living environment.
  • Economic circumstances - you have to provide evidence that the child can grow up in an economically stable situation.
